Trade secrets are an often overlooked type of intellectual property which, under certain circumstances, can be just as or more important to many businesses than patents, trademarks, and copyrights. As the name implies, a trade secret is any information that provides a competitive edge, and which derives its true economic value to a business from not being generally known by others. Trade secrets can include formulas/formulations, data, industrial processes, laboratory notebooks, technical know-how, blueprints, computer software that cannot lawfully be reverse engineered, training manuals, supplier identity, pricing/financial information, customer lists, and others. In this webinar, Warren D. Schickli and Patrick M. Torre, Ph.D. will discuss steps that businesses should take to protect trade secrets, including early identification of sensitive information qualifying as trade secrets, compartmentalization of such information, and steps to take during interaction with potential, new, and departing employees. They will also discuss the importance of written agreements in the protection strategy for trade secrets.

Warren D. Schickli is a member of the Intellectual Property and Technology Law Group at Stites & Harbison, PLLC in Lexington. He represents clients in all matters of intellectual property including patent prosecution, enforcement and clearance, trademark prosecution, copyright prosecution, and trade secrets matters. Mr. Schickli was selected by the U.S. Patent and Trademark Office (USPTO) and served as a 2023 National Patent Application Drafting Competition Midwest regional judge. He received his B.A. from Denison University and his J.D. from the University of Kentucky J. David Rosenberg College of Law. He is a member of the American Intellectual Property Law Association and the Kentucky, Louisville, and Fayette County Bar Associations. Mr. Schickli is admitted to practice in Kentucky and before the USPTO.

Patrick M. Torre, Ph.D. is a registered patent attorney in Stites & Harbison's Intellectual Property and Technology Services Group in Lexington. He is admitted to practice in Kentucky and before the USPTO and U.S. District Court for the Eastern District of Kentucky. His practice focuses on intellectual property protection strategy, including counseling clients on issues of infringement, validity, and patentability, trade secrets and transfer, and intellectual property licensing. He holds a Ph.D. and master's degree in animal science from the University of Tennessee. Prior to entering the practice of law, he worked in academic research in the areas of animal science, life science, biotechnology, and the intersection of immunology and nutrition. After completing law school at the University of Kentucky, he served as in-house IP counsel at Alltech, Inc. in Nicholasville, Kentucky. He is a member of the American Intellectual Property Law Association, the American Bar Association (Health Law Section), and the Kentucky Bar Association (Intellectual Property Law Section CLE subcommittee and public & professional affairs committee). In 2025, he served as Midwest regional judge for the USPTO National Patent Application Drafting Competition.
