Kentucky school districts face increasing scrutiny over how public education funds are spent, while attorneys are navigating new professional risks associated with the use of artificial intelligence. In this timely session, John Powell, Staff Attorney with the Kentucky School Boards Association, examines the constitutional limits on school district spending by exploring six provisions of the Kentucky Constitution and more than forty years of Kentucky case law.
Participants will gain a practical understanding of how courts analyze education-related expenditures, with particular attention to two current issues: 1) the public-purpose doctrine governing school spending and 2) the evolving legal landscape surrounding superintendent contract disputes.
The session concludes by examining a growing ethical concern for legal practitioners—the risks of relying on AI-generated legal work that presents unsettled law with unwarranted certainty. Through a discussion of three recent 2026 decisions, attendees will learn the consequences of failing to verify AI-assisted research and the importance of recognizing when the law remains unsettled. By connecting these topics, the session emphasizes critical skills for today's attorneys in identifying legal uncertainty, communicating it accurately, and incorporating important analysis into effective legal practice.
